Yes, there's plenty of Chinese knockoffs of Pokemon still around. The thing is, Nintendo probably WOULD like to C&D them, but because it's a foreign company, it wouldn't work. A Chinese court would NEVER defend a foreigner's copyright, so companies don't bother fighting a losing battle.

So that's why trademarks are so heavily protected, even if it's ultimately nothing but a name. People like >>32014520 >>32014597

But fangames are the easiest way to break into the industry. You just make a fangame based on a popular franchise to draw fans, then you change the game just enough to be its own thing later and sell it. Worked for games like Undertale and whatever that horse fighting game was. I'm surprised the Prism developers aren't trying that.

Stardew Valley is a very well-selling game and literally every single aspect of the game is ripped directly from Harvest Moon. There's nothing stopping something like Pokemon Sage from crossing out the word "Pokemon" from the title and claiming it as its own game.

Now, I understand WHY GF does this; they're simply trying to protect their trademark so that they don't lose it. That's perfectly fine. And if things stay the way they are, where fangames have to be leaked on shady websites instead of being safely released, then I can deal with that. As somebody who has worked on a fangame, it not being for profit isn't just an instant "IT'S FAIR USE NOW" button.

Nintendo/Game Freak don't care if you mske fangames. The developers love that people love their work. The reason why they get C&D'd isn't their nature as derivative products, as if that were the case fanfiction.net would be fucked. The reason is that Nintendo's lawyers don't want it to look like they're condoning using their IPs to make imitation products because that causes them to lose their grip on the copyrights, and in some places if they don't shut it down they actually will lose their copyrights because the leniency will set a precedent.
