A pokemon will only get into a tier if it has enough usage, one cannot arbitrarily determine something is OU by its power level, if it isnt used it wont get to OU.
Think of Staraptor, Banned for being to good, but not used enough to get into OU.
Or the opposite, Typlosion and Ambipom are dogshit but they are still in the tiers they are because people keep using them.
Tiers are about usage.
Banlists are about being too good for a tier, this includes Uber being the Banlist of OU.If we speak technically ubers is BL0 by purpose since its the border between usage based play and non usage based play.
