If the creators hold the rights (for example Kev Hopgood had to be paid for them to use the War Machine armour AND the Hulkbuster even though he didn't create Rhodey or Stark) then they shouldn't sign off on it if they don't accept changes will be made. If they don't hold the rights then tough fucking titty, it's not their choice.
