On one hand, you have tons of passionate, dedicated fans who just want their love and support for a particular franchise to not be punished by corporate overlords. On the other hand, you have genuine shitbags who are ready and willing to destroy intellectual property so they can profit over somebody else's otherwise protected work, and will do so any way they know how.
Copyright, trademarks, intellectual property, etc. are not permanent things. Once you pony up the money to have such things, you HAVE to defend them.
Let's say Nintendo finally pays attention to one of those Pokemon-ripoff games on iOS, and this shit goes to court. The other side could look at projects like, say, Pixelmon, or many of the other fan games, and say "Yeah well these people were using your IP and you didn't do shit!"
If you want your fan project to succeed, you need to keep it on the down low. It's when these things get big, get media attention or show up on far too many YouTube channels to be ignored, is when they get struck down. If anything, Pixelmon being taken down is a sign of its success.
