From what I can see a lot of the Pokemon-based fansites (and even fanart) would be considered copyright infringement and could legally be taken down whenever TPC chooses. However, TPC doesn't always do this because these fansites and simulators may generate more interest in their games and actually drive up revenue. It's really a cost-benefit thing - is the simulator taking money away from TPC, or could it be used to generate interest in the games? Showdown is quite possibly the latter since it's a simple simulator and not an actual game like some of the fan games. Pixelmon could also fall under the fan games thing where people might be dissuaded to buy the games and instead just play Pixelmon.

However, even if Showdown gets taken down people will just use Shoddy. And if Shoddy gets taken down, people will just use Netbattle again or something. Or someone will create an all new simulator for a while. iirc these aren't hosted on Smogon's site so TPC can't exactly nail Smogon down. In addition, Smogon likely counts as a fan-based site like Serebii so it's unlikely to ever be struck down as well. Finally, Pokemon Showdown (and Smogon) have been name-dropped several times already on official streams and such.

Frankly, I doubt that TPC will actually take it down even if it is copyright infringement. They probably think it's helping them out more than it is negatively affecting them.

I'm pretty sure big VGC players use Showdown to test stuff before they actually breed so they'd probably side with PS in case TPC tries something.
