Things like moves legality, held items, and unobtainable Pokémon aren't covered by the basic hack check that's built into local battles, single-player gameplay, and Pokémon Bank, the logic being that they could be released in an event at any moment, and they don't want to have to release an update every time there's an event (which is every couple of weeks, worldwide). The non-internet connected hack check basically only extends as far as whether the Pokémon can be represented in the standard memory format (so, for instance, you can hack a Slaking to have huge power, but once it tries to save, it'll just save it as Truant)
Having said that, since Pokémon Bank requires an internet connection, it's entirely possible for them to add an extra online hack check to it like they do with the WiFi features on-cartridge.
Also, in every case so far, the hack check only extends as far as the Pokémon you actually battle/trade/transfer. If you take your hackmon off Pokémon Bank onto a game you should be fine.
Banning is very, very rare. You're far more likely to just get rejected from WiFi when you try to use the hacked Pokémon, rather than being allowed to use it and then banned later on.
