Are pokemon gotten from emulation/flashcarts on the original games legal? Will Poke Transfer deny them? Want to play Gen 4 and Gen 5 again.

There's no difference in the data, so they're fine. Even Pokemon from some basic romhacks are transferable.

Only Gen 1 romhacks are fine with Pokemon appearing where they shouldn't since that data isn't recorded. It's recorded in every other Gen and that data is checked on transfer.

Difficulty hacks are fine.
