They aren't rules, they're fan made glorified terms and clauses for Pokemon, using plenty of pokemon related imagery, the battle system, moves, etc. It can MOST CERTAINLY get a C&D.

Pokémon Showdown has existed for six years at least, and before that there were Pokémon Online, Shoddy Battle and so on. So there are two possible reasons for why they haven't been C&D'd yet: either they already examined the case privately and realized they have no legal grounds to stand on, or they just don't give a shit about this. In any case, a C&D is not happening any time soon so don't get your hopes up.
