I think gamefreak is militant about keeping universes separate(except for ash greninja) in dppt there was a trainer meant to reference a movie and it was painfully subtle

Oh, I'm sure there's no legal grey area surrounding Gale of Darkness or any of the other console Pokémon spin offs. Gamefreak just don't want to because they didn't make it.

That being said, with Pokémon making the switch™ to home console now would be a great time to reintroduce him.
