I know this sounds like a dumb question to ask, but I'm legit curious why Nintendo openly dmcas every fan game out there while they continue to turn a blind eye towards places like Pokémon Showdown.

Is there some unspoken agreement somewhere I'm missing?

Showdown is keen to advertise it is not a game. But a simulator so that could be it.

Why would they do that to Showdown? It's just a simulator

In some way, unexperienced users may be lead to buy the game after using it. It could be seen as some sort of subtle promotion

Smogon has less pilfered game assets than most other decent Pokemon fan sites. Serebii would fall earlier than Smogon would by that measure.

Pokemon Showdown is a completely different website that Smogon endorses as its current main simulator. THAT'S the site that could reasonably be DMCA'd.

The answer is probably: They don't care.

Gamefreak doesn't even do takedowns of stuff like App Store bootlegs that are charging money for Pokemon games, so they seem to just not care about protecting the IP much at all.

Because that would put basically kill the competitive scene. A lot VGC competitors also use Pokemon Showdown and would probably not compete in TPCi-sanctioned tournaments if it went down.

But I'm more surprised by ProjectPokemon (the site responsible for shit like PokeSav and PKHex) not getting one.

Well showdown is registered to some chink in US so they could easily DMCA it if they wanted.

I did notice it has the clientTransferProhibited restriction suggesting theres been attempts to hijack the domain in nthe past.

Nintendo actually can't do takedowns of (overwhelmingly) Chinese bootlegs because of China's copyright laws which more or less allows piracy as long as the end product is slightly different from the original.

Nintendo moving more and more of their official products into China could help curb the influx of bootlegs.

Showderp? I have no fucking clue. The majority of the player base doesn't buy the physical games and they don't go to tourneys because they have their own fanfiction rules.

Fact of the matter is if Nintendo is even actually aware of Smogon (Again, more specifically Showdown) and it's massive influence in the same way the average /vp/ user is, which I doubt, then they've probably had this conversation internally and decided that the amount of research and evidence needed to clear up wether it's how I see it or >>35107404 sees it isn't even nearly worth it as >>35107461 says, there's no real money involved, though it hasn't stopped them shitting on mods before.

Most other Japanese companies don't generally give a shit about stuff that breaks copyright law (EX people can sell hentai of a series openly at conventions).

But Nintendo regularly shuts down fan games.

Being a simulator doesn't immediately prevent you from any legal issues. Dueling Network was a site that claimed to be a "simulator" of Yu-Gi-Oh! but Konami eventually DMCA'd them and forced them to remove all the card art on the site, a pretty integral part to the game. Eventually they just shut down the site before rebranding as Dueling Book. I wouldn't be surprised if Nintendo does the same down the road, something like forcing them to remove all sprites or just shutting down the website entirely.

I don't know all the details about that example you gave, but Dueling Network was different from Pokemon Showdown because YGO didn't have a story. You still had to actually buy the real Pokemon game if you wanted to play the story, so Showdown doesn't outclass the games in that aspect. But something like Dueling Network might've outclassed paper YGO

The law doesn’t really work that way. Doing less copyright infringement than others doesn’t render it legal. Also, in the US, you have a duty to actively protect intellectual property. You’re right that they probably don’t care, but they really should for Smogon.

Wrong. Square in particular hunts down fan games and mods. Hell they're the whole reason why Project M went down, they wouldn't lend Cloud unless Nintendo dealt with it.

They're problems if they make any kind of profit you retard. Prism and Uranium were hosted on sites that gave ad revenue.
In the case of chink ripoffs though they can't do a thing because of China's lax copyright laws. It would literally cost them more to fight to take it down than they would get.
