I imagine they have to be aware that they're being caught. Like, it's up to them to make the choice. As for the "low health=higher catch rate" thing, well, they just got their ass handed to them, they might be feeling some respect for the trainer.

If you catch one while it's asleep though then fuck if I know how that works.

Pokemon don't actually "faint", they just get too exhausted to battle anymore, and need to rest before they can fight again.

When a wild Pokemon "faints", it runs off somewhere to rest.

I assume the pokemon world has the equivalent of game and fishing laws irl. You need a pokemon to fight/catch pokemon without permit, you can’t capture unconscious pokemon. Even battles have regulations.

Because it's not considered fair as a trainer. There's probably laws about catching fainted pokemon, and since you play as an upstanding trainer who obeys the laws and practices good sportsmanship, you are unable to catch fainted mons.

I don't know. There's no way they can stop you. There's no practical reason to make it so that poke balls only activate on registering consciousness. The only other reason to even be concerned in that aspect is the ethical implication, and that is unclear in the games. There are some that insist that pokemon willingly join you, and others that insist that the pokeball is a mind control device. Given that they don't have a clear position on the treatment of pokemon either, it could be both. (yes, if the pokemon isn't willing to obey you, it will force it to) This would mean the mechanism is only in place for the bleeding hearts that insist on ethics. Then again, if that was the case, there should've been a way to turn it off.

A combination of both makes sense. The great, ultra, and master balls could be versions with mind control devices while the standard pokeball only works on willing pokemon. The repeat working by linking the pokemon you're trying to catch to some kind of hivemind of the pokemon of the same type you have stored, the heavy ball is designed to penetrate thick layers of fat or rock that cover the skull, and so on

The internal workings of a pokeball actually function similarly to a snare trap in that a pokemon has to actively push against the capture lock in order to be secured. If the pokemon isn't weakened enough, they'll break through, but if the pokemon is unconscious and won't fight, the snare won't close in around them in the first place.

I like these explanation a lot, combined they may be the answer.
Turning them into your allies requires them to be conscious.
The pokémon must choose to give in, so it is consensual, which allows for friendship to start developing, and Team Plasma's argument of forced slavery fails. The pokéball however still entices them to seal the deal, with better pokéballs being more appealing.
