Why don't these people mix up the mechanics a bit so that it can be seen as separate enough from the source material, and possibly even make money legally? They can't exactly copyright the concept of elemental monsters battling.

Because pokemon are copyrighted, even if you change the battle mechanics.

And you could change the monsters and keep the battle mechanics and it'd be mostly legal.

Also, it should be mentioned that ROM hacking is per definition illegal. If you wanted to make your own game with different monsters you'd have to do all the graphics, music, etc on your own. Changing the battle mechanics a bit goes hand in hand with new monsters and moves, but that can remain mostly the same.

Yeah, I worded it pretty poorly. Basically keep the spirit and genre but switch everything else up. Names, designs, assets. Quite a few more ambitious projects do most of this but stay married to calling it Pokemon for some reason.

Several reasons:
1) Exposure. Pokémon is a big-name franchise and the Pokémon ROM Hacking / Fan Game scene is as big as ever.
2) Convenience. There's already a tonne of sprites, resources and everything to help you get your game started.
3) Familiarity. If you don't explicitly call it a "Pokémon game" people will dismiss it as trying to rip off of Pokémon, especially if it's commercial.

It was released.
They can't officially support it any more, but also... they finished it? It's out there? You can still download it remarkably easily and it's still being played?
The devs achieved their goal. This wasn't any kind of loss for them; it was a completely harmless act by NoA out of obligation to defend their copyright, not an attack at the devs' expense.
People need to stop freaking out about this and realize the takedown was only nominal. It's not some kind of attack on the devs and it didn't do anything to invalidate their work - it's a formality at best.
Bonus points: there were plenty of incomplete demos, but NoA still waited until the full game was complete and released. Uranium aside, this is a constant among Pokémon fan games: historically, none of them have been taken down while still in progress and with an incomplete main campaign. They are fully aware of what they're doing; it's not an accident that they wait for the games to be completed before they take action.
Do you seriously think they're trying to hurt the developers or ban fan games or something?

I never said there was anything wrong with Nintendo protecting its IP. I just think it's kind of counterproductive when fan games don't try to deviate more from the main series when they've already made what's pretty much a new game in its own right.

If by "taken down" you mean that it was still being developed and that said development finished just a few months ago on the game's subreddit, then yes.

Just to get an understanding so if I was to make the game on say RPG maker even if I used the likeness of pokemon's battling mechanics if I made everything from scratch I could call it a legal parody for entertainment purposes?

IANAL, but just don't make the game similar enough that it could be called a straight-up clone. Pokemon simply uses classic RPG mechanics that have been done over and over again by tonnes of people. With working up from the ground comes different moves and probably rebalancing/rethinking of the mechanics anyway, so it's often not even desireable to make a carbon copy.

And even if you wanted to make a 1:1 reimplementation of the battle mechanics, it'd be really hard to achieve 100% accuracy. Just look at Showdown, they're constantly discovering new details about the engines used in the different gens.

You can't just remove all mentions of "pokemon" and change nothing else and be done with it, that's not enough for iit to bee transformative: You'd still havr the exact same moves, types, items, battle mechanicas, etc. You'd need to modify ALL of those things to be distinct ENOUGH that you can argue it's pokemon inspired rather then just not-pokemon. And since pokemon's entire concept relies on typing and moves and such, you'd need to significantly rework and come up with a ton of new things to make that work.

it really just depends on what they happen to not only notice but choose to care about.

for instance there are dozens of Zelda and Mario fan films on YouTube, but occasionally one gets shut down if they start fundraising publicly to fund it, sell dvds, or go around screening it in real theaters at film festivals or something
