They can't do shit, I've already explained why a few months ago when another guy tried to do the same thing, but essentially fair use protects Smogon from ever going down since it's merely a fan site that denotes a certain ruleset and just discusses the game in their own merits instead of devs of a fully competing game using their own assets.
In Showdown's case, they label themselves a simulator (which is in eternal beta) rather than a game, and they don't even emulate 20% of actual Pokemon games, you can pretty much boil Showdown down to a calculator with fancy graphics. Even if they somehow manage to get a legit c&d and take Showdown's main server down, they still have smogtours, pandora, etc, etc and new servers will keep popping up for as long as it takes. Not to mention it's not even the only battle simulator, there's still PO and I think either shoddy or net battle are still around. It's an unwinnable battle for tpci.
