They are probably well aware. But this is a straight port. The only work they did on this is creating icons on the 3ds homepage. The emulator existed and so did the rom. In fact, you can replace the rom and run and GB game.

Then you hack your 3DS, buy/pirate the VGB version of Red, and then replace the save of the VGB with the one you pulled from your cart.
