>>36653183If you look deeper into the data it becomes apparent that Mew was indeed put later (it has non-default cry values, unlike most of Pokemon at indexes 1-30; its sprite is in bank 1 instead of 9-14). It was put at the very first Missingno slot available, which means it technically replaced another scrapped Pokemon.
As for trademark and Mewtwo, the name that was trademarked in 1990 was spelled a bit differently and maybe referred to something else. Or they envisioned a Pokemon Mew but didn't intend to put it into the game, but only refer to it in lore. Shigeki Morimoto stated that he designed it after the development tools had been taken out of the game, so if anything it was Mew that was designed after Mewtwo.
