Nintendo just owns trademarks (logos, names). Game Freak could do whatever they wish if they leave Nintendo trademarks out of it.
Also, Game Freak has all the power here, you know that, right? If Game Freak wanted they could leave Nintendo consoles and shit easily. Nintendo might play hard ball for a time but the answer would never end up as a "No." outright because they'd still be making a third of the company overseeing it.
If Game Freak doesn't want to make them for their consoles then they have to go along with it lest they be left out of them money loop.
This'll never happen because of the way the Japanese are and because it would be infinitely stupid but Game Freak giving Nintendo the finger and just renaming everything for a multi-plat game could absolutely happen.
