The problem is that they were harassing wild Slowpoke. To gather Slowpoketails, you need a harvesting licence and domestic Slowpoke.

So, if I had to guess, you can ethically harvest Slowpoke tails simply by waiting for them to fall off. I can only assume Team Rocket's behaviour was illegal specifically because they were hacking off Slowpoke's tails to make a quick buck, which would be animal abuse. It likely has less to do with domestication and more to do with the ethical treatment of Slowpoke in general. That said, it wouldn't shock me if you needed a licence to sell or serve Slowpoke tail, as even in Sun and Moon black market sales of Slowpoke tail seems to be an issue.
