Literally this, hacking is easy enough if you have an early switch, but you're basically getting banned if you go connect to the internet afterwards
This console reports a shit ton of data to Nintendo, unlike the 3DS
(Don't know if this is still the case with Atmosphère tho)

if you stay offline and restore your nand to a previous state where you didn't hack you won't get banned. It's like wiping everything while you were offline so Nintendo can't tell you were hacking. I'm still not banned and plenty others aren't from restoring nands, but you need a clean one.
