Unless you're talking about the animated intro, in which case I agree that would look better but don't think it would play nice with the perspective; it's a very flat art style and I think it would look strange in anything but a sidescroller.
In any case, you shouldn't see the promotional art as what the game was "meant to" look like.

It's not like it isn't in full HD. It's just a simple aesthetic.
In fact, going for a completely new aesthetic like this is risky, as proven by the very mixed reaction it's received.
That said, even a "lazy" art style can work quite well. Minecraft manages to look good and it's literally coder art.
I'm not totally sold on the game yet myself, but if it adds new content and isn't just a straight remake then I think it's going to be pretty good. And even if it is a straight remake, there are plenty of kids who've never played LA.
