Nintendo did that when they gave them the 3DS to work with anon. The fact Gen VII had to force-boot the OG 3DS into a safe mode to be able to even run the games is proof of that.

You never noticed how long it takes to boot and that hitting the home menu takes ages? I would imagine if 3D was enabled that the game would crash immediately.

Yep. It's clearest when going to home menu then closing the game. It closes, then screen goes blank for 5-10 seconds before returning to Home screen, while my NN3DSXL just closes then goes to home directly.
