What's the difference between PETA's Pokemon Black and Blue and fangames that don't steal assets?

I've been wondering about this, what exactly makes Pokemon Black and Blue fine but say Pokemon Uranium not fine?

I've seen a bunch of arguments saying that since PETA's game is a parody it falls under fair use, however it still uses the name and the logo of the official pokemon series.
Pokemon Uranium used the name and the logo aswell however, unlike most romhacks / fangames, it stole no assets yet it still got taken down.

What makes it even more confusing is the fact that Pokemon Clover has not been taken down yet despite its relative popularity.
It does have a bunch of joke pokemon so, is that what makes it fine in nintendo / the pokemon company's eyes?
