All you have to do is remove the Joycon.
And before you try to argue that makes it not the same do remember that you're now arguing about not closing the DS/3DS lines.
If you don't close them those likely won't fit in a pocket at all but that's what you're supposed to do meaning the refusal to do so (or, similarly, remove the Joycon) isn't a thing you get to complain about because you are the problem for refusing to do it right.
Also this means the 2DS basically has that problem by default with no way to work around it unlike the Switch but I don't see you complaining about that.
