The body shape it's no the same, Giratina's body goes horizontal while his neck goes vertical, the legs are completely different, Giratina have brontosaurus-like legs, the winds are different too.

He based it on a crab spider because he thought their backs looked similar to the shape I guess. The point is to make it look like something in the wild, there are no living ice cream cones discovered yet, and there probably won't be any discovered in the future, so that wasn't really an option.

When a pokemon is so clearly different from anything you would find in the wild, you need to take some creative liberties. That's why you see things like Froslass being turned into a bug. Bugs are easy to use because they have a bunch of weird shapes.
