If it was confirmed a pirated copy that's one thing I guess to IDF over, but if he just bought it from a store that broke street date, what's the issue? GameFreak still gets their money, the store still gets their money, and if its a legal copy he may even just be using a capture card which is perfectly legal and doesn't need a modded switch.
