If they didn't, then they're after some guys for the cost of a single book. And that's assuming that somebody broke NDA, which as another anon pointed out, it's possible that they just broke street date or outright stole it, which is a slightly different case.
Also, the bulk of the penalties presume that the Defendant(s) will try to avoid responsibility or make fallacious arguments, which you can just...not do.
Literally the only purpose of this suit would be to punish for the missing sales, which would mean TPCi has to prove that there were significant missing sales. They COULD just count "I'm not buying it because [thing that was leaked]" posts, but I'm not sure how well that'd hold up in court. It'd be a stronger argument if the got an expert to say "well they would've sold like X without interference".
Ultimately the leaker wins even if he loses the case, since that means we get to see TCPi admit that they lost sales because people found out the games are shit.
