In fact they state as much in one of the arguments in the Request for Discovery.
TPCi is factually making the legal argument that the leak of the guides damaged the marketing strategy, and thus the sales of the games. In order to PROVE that argument they will have to put a number to it: they have to openly say "this is how many sales we think were lost because our marketing strategy was ruined".
TPCi will have to openly and publically admit that they tried to pull a fast one by releasing NO information of value in hopes that they could make bank on preorders and get shills to cover the damage post-release long enough to get those Sweet Sweet Christmasbux.
