At least the azure flute was just an item and you could still legally obtain the pokemon tied to its lore through other means.

This floette doesnt even legally exist despite having it's own sig move that's even coded into swsh

It's not. It has its description but you can't actually use it.
V-create, on other hand, is perfectly usable.
You know, a move that is event-only and was distributed only on Victini and Rayquaza.
