Generally Nintendo can sue on an argument of lost revenue/trade secrets being stolen, essentially. If they signed an NDA on top of that, they can be sued for breach of contract and for any potential loss of revenue. Usually, what they tack on is lawyer fees(you can sue someone and ask for damage compensation relating to paying someone to be in court), which is enough to bankrupt the average person when Nintendo hires 30+ lawyers.
