The only numbers we've ever had were 33/32/32/3 when 4Kids owned part from their license. No reason to assume that 3 didn't go back equally making Game Freak majority.
Only way Nintendo has majority is when you consider they own part of Creatures but we don't know how much and it doesn't really work that way anyway. They'd have more pull since they have some say in what Creatures would say but not technically more ownership.
And no, the trademarks don't count. Game Freak could fuck off as long as they renamed most everything. Game Freak owns the copyright to everything which places them above the owner of a name or logo trademark.
