You need to UPDATE to get those pokemon. The updates won't always be there as the server will go down. You can end up with a cart that was never updated which only makes it worse. Ever get a glitched copy of XY that wasn't updated? Imagine not being able to update it...
At least Gamestop was free. It also was maybe one or two pokemon, not an entire section of a region and dozens of pokemon. This is a lot to be stuck losing out on and will tank the value of Sword/Shield in the long run as the games are incomplete in comparison to any other Pokemon carts.
