Hec, FreeShop ultimately was 100% Nintendo's fault - it was their own shitty security that made it possible and with enough fiddling one could download games from their servers via fucking web browser. This is why they could not sue the creator of it, too - it would be a fucking joke and embrassement for Nintendo to sue anybody for damages made by their own incompetence (worth noting that their DMCA'd original FreeShop for fucking logo, which later was replaced and that Cruel, the creator of it got later jailed for kiddy porn, but none was important in this case). Why people were surprised with Nintendo patching up FreeShop was mostly because it took them like 3-4 years and was done at the end of 3DS's life cycle, when Switch was 100% supported.
