The patch itself is free, so they'll be in the game's files, they'll just not be available for get in-game outside of trade and those sorts of methods.

I remember them stating that old mons would be implemented through a free patch, but I don't think they said anything about the new ones. If I learned anything from Game Freak, it's that we should never make assumptions.

Legendary pokemon are extremely rare and powerful specimen, they don't have to control something or even be one of a kind

The storyline of the Isle of Armor seems to be about training/making progress, and choosing what type of fighter you want to be. Having a legend about a Pokemon that trained hard and chose how it wanted to fight sounds plausible to me. But the DLC isn't out yet, so I guess we'll have to see.
