Gacha and Lootboxes can do stuff like that because its either gambling or because the user purchasing does get something in return for his money. In the case of Home, Nintendo offered a service and is trying to give itself and ‘out’ in the contract between it and its customer who has gave consideration for a service

Some good customer service right there. I haven’t been able to log in since launch. If I lost my transferred pokes it’s fine since it was just wonder trade stuff from x and y but let me at least log into the fucking app.

But that's the point, Home's not as functional as it should be
It's supposed to be an app to transfer and store your pokémon, not to delete them
If Shitfreak really were """""working hard""""" on fixing this bug, they'd at least aknowledge the problem in the first place and issue a warning to not use the app until said problem is fixed

Well, pokémon are still sometimes being deleted while they're being transfered
GameFreak also hasn't said there's an issue with home accidentally deleting your pokémon yet
Ergo, the bug hasn't been fixed since they haven't aknowledged it yet, which means they aren't working on it
