Basically, without Game Freak working with them, there would be no anime at all because they'd have no idea what to do.
Fish Pokemon floating in battle has always just been for player convenience, not something they actually do. Otherwise, a good chunk of the dex would be pretty much unusable because 99% of battles happen on land.
