you can absolutely get banned but it's very easy not to

you essentially partition your sd card and make two separate switches. use the created one (emunand) for ALL shady stuff and the legit one (sysnand) for online play

if you want to use hacked mons online that's a whole other set of issues

Your Switch won't get banned but if you participate in real official tournaments yeah you will get b&4lyfe

Pokemon since Gen 4 had their own serious legality checker that checks everything in your game, recently they are required to check your Switch too

Genned items? can be seen
Eggs that came from 6IV hacked parents? can be seen
Pokerus acquired from hacks? can be seen
Even how you EV train your shitters can be seen

Pkhex and Pokegen are basically a Fisher Price toy compared to what they use for tournaments

Fake, ignore him. When the leaks occurred a few months ago, the legality checker was leaked too. PKhex updated to match it. Should be in one of the recent patch notes

I think if the checksum is incorrect on home it just makes a new valid one, it's to prevent getting banned from identical checksums with shedinja.
