Could you use beta pokemon im fangames? I want to know if you could get sued for using these things. If pokemon didnt trademark them then they can still be used right? Or i guess if you wanted to trademark them yourself pokemon would stop you because they made it 1st, but never trademarked it. Does anyone here know?

That's absolute legal gray area unfortunately. Ultimately, work is copyrighted by its creator the moment they create it, so you couldn't steal it. But it was released unofficially, and they haven't even acknowledged its presence.

I would say no, don't use them to try and make personal profit.

Were these things coded into the game? Because if they wehre then it would be hard for you to use it. If the dint then you could just chnage the name and give it a slight touch up

Change the name and give it a slight recolor. Since they were never in any official Pokemon games you should be good to go after that.

The clearest answer would be this; if GF copyrighted a creature design, and keep refilling it, then you can't use them. Even if you change the name and recolor it, if the copyright still stands and they use it to design a new one for next next generations, then you are fucked.

I know that. My point is, if a design is copyrighted, then it is off-limits no matter if the design is meta or official. It's that simple. Corporations will do anything to fuck up their competitions, especially if the competition got potential to shake their grounds. OP is like an ant to them.
