We don't even know how much legal weight a Trainer has over a captured Pokemon if any at all, we don't know what types of rights Pokemon have if any at all. Legality is one of the many unknown things in the world of Pokemon that the writers of the world don't want to discuss as its not important...sometimes.
Small aside from this whole Pokemon/Human romance thing: Its really bizarre how Humans who try and capture Pokemon in cages get in trouble yet capturing them in a Pokeball is somehow okay despite them both seemingly doing the same thing. You capture them in a ball they still have to fight to break out and have to be weakened to lose their will to fight, same with a cage. I'd even make the argument that the cage is more humane because at least the Pokemon can break or destroy the cage from the inside, Pokeballs have to be destroyed from the outside and can be quickly transported around the planet in seconds, while a cage has to be transported manually giving the Pokemon time to rest and break out. For a setting that wants you to look at Pokemon and Humans in a healthy harmonious relationship, they sure have a really unhealthy way about starting off their partnerships.
I know not all partnerships start this way with Pokemon and Humans, a lot of them have the Pokemon choose to come with the trainer like Ash has done with his mons, but the fact still stands that a Trainer seems to fully be able to do the former instead of befriending them first and get no repercussions from the law or whatever .
