As for the patent, it is not completely impossible for them to use the name or the system itself, if they do use it they need to have SE's permission, and they have to pay and credit them. It is probably an insignificant amount of money even for greedy Game Freak/ TPC.
It isn't much alike Lucas's patent for the word 'droid'
But mentioning it in a document to explain their combat system does not infringe any patent, as it is a well-known game concept, and is most likely all that's happening here.
