Would it be illegal to comission this Fakemon to be made as a sprite? Without the author's permission? It seems scummy and I probably won't do it because of that.

As long as you're not selling them or claiming the design as your own, I don't see what the problem is.
You should probably tell the guy you're commissioning that it's not your design though.

I think a sprite involves sufficient original intellectual effort to not infringe copyright in the model. There’s precedent to the effect that a transferrence of something from one medium to another can create a new work

Drawing here. As someone who makes designs I'd like to be asked about that - on my part, if you want to commission a pixelart and use it on a private romhack I'd have not problem about that. Still if you're going to keep it private the original artist will likely never know.

Then, fuck it, you're going to do whatever you want and no one can stop you outside of your own boredom of playing a game you made yourself. I'd just be careful with who you commission since dide has a decent amount of friends in the spriting community who will tip him off.
Iirc, he has a dex on pokengine with this mon available as an encounter, i don't know if it is playable yet, but it probably will end up so eventually.
