Haven't watched a single episode of the Ashnime since the start of Best Wishes but if here's my dumbass headcanon.
When a Pokemon is caught in a Poke Ball, it's traced back to the Original Trainer. When you trade, there's a log of that happening. Thus, any region's League can track you down if you're suspected of overhunting or funding an illegal fur trade. Stuff like that. Pokemon are also often seen coming out of their Poke Balls, which means that catching them standardly doesn't actually keep them locked inside.
That's why poachers in the Pokemon world often use alternative methods to Poke Balls. You can't track a simple cage and you can't just break out of being petrified. Illegal practices want to minimalize any sort of paper trail, a trail that Poke Balls leave.

Sort of implied but we normally don't see a lot of Pokemon being caught by people unless they are affiliated with a regional professor like Oak. Thus, if the glowies see you've recently gone on a Zigzagoon catching spree and you aren't doing some sort of research into them, they're gonna investigate.
Things like trade machines exist as an easy way to transfer the title of ownership over to someone, the same way you do with a car or a gun in America.

But they can't track you down because they never found Team Rocket's illegal Pokemon poaching scheme in Celadon without some miracle kid showing up. Also how does trainer id work with gift pokemon? Gift pokemon in game have the player's id but there's specific cases in gen 2 where the original trainer still has ownership over the pokemon.

You could chalk the first one up to some legal grey area given that the same Game Corner is still open in the Johto games with neutered rewards.
As for gift Pokemon, I've got no answer for that. Could say that it's been released and recaptured or was never in a ball, to begin with for some Pokemon. The Shuckle situation makes me feel like the OT should have been that guy the whole time.
Probably some degree of separation. I was mostly going by Ashnime logic rather than game logic. In the end, this is a children's cartoon so they'll only flesh out illegal poaching enough to give the verisimilitude needed to make it feel believable while not boring kids with fictional laws.

Stealing pokemon to sell them is like stealing guns from a gun store then selling them on the black market.

Catching the pokemon in a pokeball would register it to the trainer, so if they were to sell it to someone (not trade it) it would still be registered to that trainer and if the person they sold it to was to commit a crime with said pokemon, the person who sold it would be the one who gets linked to the crime.

Thats why they dont tend to catch them in pokeballs but instead, in nets and cages so the people they sell them to, are able to catch them, themselves.
