It wouldn't be good PR, but I believe gamefreak preserves its rights in light of fakemon by not accepting fan designs, so they could do something similar to an existing fakemon if they wanted to. It's probably why they've only held contests for move names like Draco Meteor and Steel Beam. Plus, it seems unlikely that at least 60 pokemon per gen wouldn't run into this problem at some point if that didn't preserve their rights.

THat's not exactly an accomplishment these days. Nintendo have suffered a bad case of corporate marketting "genius" for two decades now, and the result is that most, MOST, fan art beats a lot of the official content.

And, by extension, if you scrape for the worst fan art, that stuff looks most like what gets into the games. And that's on purpose.
