An actual crime boss can have access to an officially sanctioned and recognized gym without any suspicion whatsoever, even though he's almost never actually IN said gym to take challengers.
The pokemon world is a lawless 3rd world planet, where the "police" that do exist are so incompetent they need to rely on drooling children to take down said mob bosses.
All this being said, Unova probably has my favorite gym leaders for the simple fact that even though they were jobbers, the story tried to make them look important by having them actually assist with the conflict affecting the world, rather than ignoring it while they sit inside their gyms oblivious to it all.
The Trial captains are cool, but obviously not gym leaders.
