They are, as far as the game and GameFreak themselves can tell, no different than genned in Pokemon that could have either been made in PKHeX or caught in an emulator. If people with 'fake' games wanted to, they could easily trade their Pokemon from a pirated/leaked copy to a real game, upload them to Home and GameFreak would know no better.
