afaik, the shinies are traceable as being glitched, so they could potentially be punishable.
However, if you've got people mass-creating shinies and trading them out, you're going to end up having a huge denomination of the online crowd getting banned, and potentially completely inadvertently.
I guess they could never introduce a wonder trade feature, and work on banning the illegitimate shinies from ever being traded, but the damage is already being done right now.
