Unfortunately for you, the story doesn't hold up to anyone who has at least a 56k modem and access to the modern internet.
For example:A recent DMCA request by Nintendo made sometime in January of 2021 took down 371 completely free games off of Gamejolt.
Furthermore, fan games that were clearly not making any money due to the way the partner program worked at the time were DMCA'd off of ROBLOX. The only notable exception to this is Pokemon Brick Bronze.

Most pokemon romhacks are small scale in terms of noterirty so they fly under the radar. If it gets too close to the sun though then it'll get burned like with Uranium
Same shit with Fire Emblem hacks though those are even less noticeable since the IP is small fries

Actually they seem to be very sensitive about any h-Doujins containing pkmn×Protagonist/NPC pairings, to the point of going after fellow Japs (however Mon×Mon & Human-only doujinshis seem to be fair game suprisingly)

But it does happen, it happened with Pokemon Prism not that long ago. I remember the creator had to get someone else to leak the game in some secretive, hard to find way.
Though he was targeted because he was promoting and hyping up the game too publicly.
