So if court doesn't attest that "violence, constraint, threat or surprise" was used, the act is declassed from rape to sexual abuse, or nothing if none of the four points were verified
Here's a 2018 example, 30yo guy fucked a 11yo girl and got away absolutely scot-free, as court determined the girl did give consent without being forced into it
