Most Switch piracy websites on the clearnet operate just fine because they all use third party filehosts and Nintendo, despite being able to harras randos on Twitter and here, does not have the resources to mess with that shit. Yes, you most likely don't even need to go that far. A lot of file upload sites would refuse to listen to any sort of C&D or request for information from Japan or most other major countries. Just saying if someone wanted to be really sure, onion would be overkill but would make it near impossible for Nintendo to find them.

But again, it's all moot, the games won't go on sale as early as you're thinking, it's unlikely we'll get another discord reviewer leak, they're not localising (as of yet) the guide book, so aren't printing a run of copies to spoil pokémon live from the print shop, so you're stuck with waiting for the game to break street date, which doesn't happen generally until the final week before its release. But do keep thinking some White Knight is going to upload the game today.

Depending on the circuit you get it can be more than enough to download a file that large in a few hours, or at worst overnight.

And again, it would just have to be for the upload. And here's a little hint, you can split archives and upload them across different TOR circuits all at once.
