Except they don't because switch homebrew is injected before the system boots into the OS. Most pirates don't even update their homebrew's switch OS ver and instead just patch the games' "required ver" to be 1.0.0 so they run. This isn't for sec. reasons, they're just too lazy to get the newest switch OS version.
