The thing is you know that this shit will be overpriced to hell. Used games market is a big thing and used games are extremely cheap. I just don't see any practical use case for this unless it's cheap. At best you'd use this to try out a game you thought you would play but would never have regardless.

It'd likely not, every cartridge also has a unique identifier, unless they found a way to spoof that very likely Nintendo would just blacklist the carts they're trying to steal that id from
