They still are. Nintendo isn't going after copyright or trademark infringement, but is suing them for patent violations. Ok so Nintendo is not suing Pocketpair over copyright infringements and instead are suing them for patent infringements. We don’t know exactly what patents they are suing Pocketpair over but we do know it is not based on designs of their creatures.

They wanted to go for the patent infringement first but had to wait until the patent was finally approved. To be clear they filed the patent before Palworld, but I think it's obviously the weaker case. Their Lawyers would disagree
